Public Hearings, Extended and New Comment Period

DEP is aware of the significant public interest regarding additional public participation opportunities for this project. DEP chose to extend the comment period on the Chapter 105 applications and has opened a comment period for the Chapter 102 application. Comment periods for the Chapter 105, Water Obstruction and Encroachment Permit Applications and Chapter 102, Erosion and Sediment Control Permit Application for Earth Disturbance Activities will be open through April 17, 2018. 

DEP has elected to hold a public hearing in each of the counties on the pipeline route before the end of the comment period: Allegheny, Beaver, and Washington. Details are being finalized and will be posted, noticed in newspapers and the Pennsylvania Bulletin, and conveyed in a press release once finalized. 

Residents who wish to offer testimony can pre-register by contacting Lauren Fraley, DEP Southwest Community Relations Coordinator at lfraley@pa.gov or 412-442-4203.

Individuals will have the opportunity to present up to 3 minutes of oral testimony relevant to the permit applications before DEP. For those who wish to testify but are unable to pre-register as provided below, there will also be an opportunity to register on site on the evening of the hearing. In order to accommodate the greatest number of residents interested in testifying, DEP requests that organizations designate one individual to speak on their behalf. DEP will record testimony and receive written comments throughout the hearing and will accept written comments until April 17, 2018.
All hearings will begin at 6:30 PM and end at 8:30 PM, with doors open and onsite registration beginning at 6:00 PM. Hearings may conclude earlier if all testifiers in attendance have spoken prior to the designated end time.

Joint Permit Application For Pennsylvania Chapter 105 Water Obstruction and Encroachment Permit and U.S. Army Corps of Engineers Section 404 Permit (January 20, 2018)

On January 20, 2018, DEP provided notice in the Pennsylvania Bulletin that the Joint Permit Applications for Pennsylvania Chapter 105 Water Obstruction and Encroachment Permit and U.S. Army Corps of Engineers Section 404 Permit were under technical review for Shell Pipeline Company’s Falcon Ethane Pipeline. 

DEP is extending the comment period through April 17, 2018 on the following permit applications.

Any written comments, suggestions or objections should contain the name, address and telephone number of the person commenting, identification of the specific application to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based. Comments can be submitted electronically by emailing RA-EPWW-SWRO@pa.gov. 

Notice of Intent (NOI) for Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities (ESCGP-2) (February 17, 2018)

On February 17, 2018, DEP provided notice in the Pennsylvania Bulletin that the Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities (ESCGP-2), Notices of Intent (NOI) was under technical review for Shell Pipeline Company’s Falcon Ethane Pipeline. The applicant submitted a NOI for coverage under an ESCGP-2, however, DEP has determined it appropriate to process the application as an Individual Chapter 102 permit.

DEP will accept written comments through Tuesday, April 17, 2018 on the Chapter 102 permit application.
